If the au pair is a “resident” of the United States for tax purposes, the employer must withhold Social Security and Medicare (FICA) taxes, and file both Schedule H and a W2. If the employer is withholding any taxes OR withholding from wages and paying these taxes to the IRS, they must provide the employee with a W2 and file that with the SSA each year. Learn more here.

Au pairs on a J-1 visa will likely have an income tax liability because they cannot claim the Standard Deduction as nonresidents, per the IRS. However, they are exempt from paying Social Security, Medicare, and unemployment taxes.

Generally, au pairs cannot claim tax credits like the Earned Income Tax Credit or the Lifetime Learning Credit due to their nonresident status. It’s essential to consult a tax advisor to understand specific eligibility requirements.

If you pay an au pair more than the applicable dollar threshold detailed in IRS Publication 926- Household Employer’s Tax Guide, you’ll need to file this form as part of your individual income tax return.
